Kent County Special Orders and Decrees (Vol. 1)

 Item — Box: 1
Identifier: RH-A-4338

Scope and Contents

This finding aid contains a single volume of special orders and decrees from the Kent County Circuit Court in Chancery (in process of litigation). It covers August 20, 1850, through September 17, 1857. The circuit court is in Grand Rapids, Michigan.

The collection is made up of one volume with entries relating to case numbers. The cases in the book cover special orders and decrees from the Kent County Circuit Court in Chancery from August 20, 1850, through September 17, 1857. The types of cases include mortgage problems (including judgements of foreclosure sales), dissolution of marriages, and general court cases. There are several orders to have advertisements placed in local newspapers to alert individuals that they are required to appear in court, and the date they need to appear.

The overwhelming majority of the cases in this volume were presented to and decided by the Honorable George Martin. Other judges who oversaw proceedings were Edward Mundy, A. (Abner) Pratt, and Nathaniel Bacon. In addition to the orders and decrees by judges there are entries by circuit court commissioners (Charles C. Rood, Thaddeus Foote, and E. Seymour Eggleston), solicitors (S. Bennet, Rathbone & Seeley, H. H. Riley, S. Patters, James Miller, Whitney & Eggleston, J. Seeley, and C. P. Calkins), and Charles P. Calkins as Injunction Master for 5th Judicial Court. The person who registered the entries is not always named, but when they are it is either Reuben H. Smith or P.R. L'Pierce.

There are three small newspaper clippings attached to related cases. All three have the common factor that David Caswell Jr. and his wife Laura Caswell are named defendants. The three cases all ended in a "Sale in Chancery" of their property, as well as water and mill rights, in Grand Rapids, Michigan.

Physical Description

The collection amounts to .25 cubic feet and is one hardbound volume measuring 12.5" x 18". The original binding appears to be tan, but the front cover is now mottled gray, probably from a past mold problem. The comers of the front and back covers are reinforced with red leather embossed with a gold pattern. There are 475 numbered pages that are lined with blue ink and have a left-hand margin printed in red ink. The pages are yellowed around the edges but otherwise clean with only minimal fingerprints in ink. Some entries have numbers next to them, perhaps related to their case number, but these numbers are not in sequential order.

The entries were recorded in cursive script by different scribes so style varies. The ink is light and the words of most writers have little space between them, so reading can be difficult but most entries are legible.

All but the left margin of a blank page was removed before page 57. An explanation states it was because of ink blots and that nothing was written on the pages before removal. The small piece of remaining paper was taped down to page 57 and the tape has yellowed over the years.

Some entries have added information in red ink that is written 90 degrees from the original. The page needs to be turned so the left-hand side is the top in order to orient it propyrly for reading.

Three small newspaper clippings are attached to three related entries. One is attached with a nail, another with glue, and the final with tape.

The spine reads: SPECIAL ORDER [sic] AND DECREES [on a black patch with gold lettering and top and bottom borders] VOL. 1 [printed in black ink] KENT COUNTY [ on a black patch with gold lettering and top and bottom borders]
